By a majority the Rwanda deal to deport asylum-seekers has been ruled unlawful by the Court of Appeal, after judges concluded it is not a safe country to receive those claiming refuge and has recognised problems with the process. This landmark decision found that the deficiencies in the system in Rwanda were of a significant risk to asylum seekers where they could be sent back to their home countries and face further mistreatment and potential persecution, which contradicts Article 3 of the European Convention of Human Rights.
The court has concluded that, until the systematic errors in the asylum system are corrected, the removal of those seeking asylum to Rwanda will be unlawful.
