Road Traffic & Criminal Law Fees

OUR ROAD TRAFFIC TEAM

Allied Goodwin Solicitors’ criminal team cover a wide range of criminal related areas, including Road Traffic Offences at the Magistrates Court.

Our Road Traffic team consist of 4-Members: Member 1 ( Duty & Solicitor-Advocate, Director), Member 2 (Duty Solicitor), Member 3 (Duty & Solicitor-Advocate) and Member 4 (Duty Solicitor). At times we may offer the choice of other staff members not listed here and consultants who are experienced and qualified to take on your matter.

Member 1 and Member 2 are departmental heads of Road Traffic Team and they both hold supervisory roles for all other team members within the department.

FUNDING OPTIONS

A range of funding options are available in road traffic matters including hourly rates and  fixed fees, the hourly rates are between £200.00 to £350.00 (excluding VAT) per hour.

Our below estimated fixed- fees are for consultations and representation at the Magistrates’ Court Hearings relating to driving offences that are limited in sentence to a financial penalty and/or endorsement with points.

Please note that the fees quoted below are exclusive of disbursement costs such as travel, parking (if applicable) and/or the costs of instructing experts and third parties in your matter.

(1) TRAFFIC LAW CONSULTATION

Traffic law consultation at our offices £250.00 (exc. VAT) whereby a Solicitor will verbally advise you at the consultation.

(2) GUILTY PLEA HEARING AT THE MAGISTRATES COURT

Guilty plea hearings during any one magistrates court date for anyone driving offence.

Average fees range from: £250.00 – £350.00 (exc. VAT) and does depend on location of the hearing.

  • We do not offer an hourly rate service in these types of matters.
  • A solicitor from our office or barrister of our choice will represent you at your hearing.
  • If multiple driving charges are to be dealt with at the same hearing, an extra £100.00(exc. VAT) will be charged to deal with all offences.
  • If extra hearings are required on separate dates due to circumstances beyond our control, each separate hearing will be charged at £250.00 (exc. VAT).

DISBURSEMENTS

  • We do not envisage that disbursements outside of our travel costs will be incurred in these types of cases.
  • In some specific scenarios a medical expert will be required to give opinions. The average cost of instructing a medical expert range from £1500.00 –£2500.00 (exc. VAT)
  • If your case relates to drink/drug driving, occasionally a drink driving expert may be required to give evidence. The average cost of instructing a drink drug driving expert range from £1500.00 – £2500.00 (exc. VAT)

(3) GULITY PLEA HEARING (EXCEPTIONAL HARDSHIP APPLICATION)

Guilty plea at one magistrates court hearing for any one driving offence, where an Exceptional Hardship application is made and heard on the same date.

  • Average Fees range from: £600.00 – £750.00 (exc. VAT)
  • We do not offer an hourly rate service in these types of matters.
  • A solicitor or barrister of our choice will represent you at your hearing.

If extra hearings are required on separate dates due to circumstances beyond our control, each separate hearing will be charged at £250.00 (exc. VAT)

DISBURSEMENTS

In some specific scenarios a medical expert will be required to give opinions. The average cost of instructing a medical expert range from £1500.00 – £2500.00 (exc. VAT)

(4) SPECIAL REASONS HEARING

  1. Special Reasons Hearings, including 1st appearance and a special reason hearing on a different date.
  • Average fees range from: £750.00-£1000.00 (exc. VAT)
  • We do not offer an hourly rate service in these types of matters.
  • A solicitor or barrister of our choice will represent you at your hearings.

If multiple driving charges are to be dealt with at the same hearing, an extra £100.00 (exc. VAT) will be charged to deal with all offences.

If extra hearings are required on separate dates due to circumstances beyond our control, each separate hearing will be charged at £250.00, (exc. VAT).

DISBURSEMENTS

(6) TRIAL OR NEWTON HEARING

  1. Trial or Newton hearings, including first appearance.
  • Average fees range from: £1500.00 – £2500.00, (exc. VAT).
  • We do not offer an hourly rate service in these types of matters.
  • A solicitor or barrister of our choice will represent you at your hearings. A file handler will prepare your case.

If multiple driving charges are to be dealt with at the same hearing, an extra £100.00, (exc. VAT) will be charged to deal with all offences.

If extra hearings are required on separate dates due to circumstances beyond our control, each separate hearing will be charged at £250.00, (exc. VAT).

DISBURSEMENTS

In some specific scenarios a medical expert will be required to give opinions. The average cost of instructing a medical expert ranges from £1500.00 – £2000.00, (exc. VAT).

If your case relates to drink/drug driving, occasionally a drink driving expert may be required to give evidence.

The average cost of instructing a drink drug driving expert ranges from £1500.00 – £2500.00, (exc. VAT).

If a road traffic expert, such as a vehicle engineer is required to give an opinion in your case, further disbursements will be incurred. The average cost for these types of experts ranges from:  £1500.00 – £2000.00, (exc. VAT).

The fees quoted above relate to Summary Only driving offences that carry a maximum sentence of penalty points and or a fine and that would fail the interests of justice test in terms of the test for Legal Aid.

These fees therefore do not cover representation for offences such as driving without due care and attention and dangerous driving OR matters that need to be dealt with at the Crown Court, including appeals.

CROWN COURT AND OTHER NON-RELATED ROAD TRAFFIC CASES

Should you have a serious driving charge or other criminal charge, you may be eligible for legal aid and if not, we may still be able off you bespoke quotation (under a fixed fee arrangement or at an agreed hourly rate).

The costs of defending against a serious driving charge is difficult to accurately estimate without further details as such cases will be dependent on the circumstances and complexity of the case.
